
To my same sex parents – are you wondering if you need a second parent adoption? Here are some questions to ask yourself:
📌Did you have a child with your spouse before there was marriage equality? (Answer is YES – then you need a second parent adoption!)
📌Are you genetically related to your child? (Answer is NO – then you need a second parent adoption!)
📌 Are you on your child’s birth certificate? (Answer is YES or NO – then you need a second parent adoption!)
📌 Is your child’s birth certificate the only legal document you have connecting you to your child? (Answer is YES – then you need a second parent adoption!)
Here’s the thing – birth certificates are issued by state agencies. They are NOT court orders. Because of that other states do not have to recognize their validity, BUT other states DO have to recognize the validity of the court orders, such as final orders of adoption, from other states.
