Anyone who has been through a surrogacy or donor arrangement will tell you that trust is a KEY ingredient of a successful arrangement. The best way to instill trust in the contract process is to make sure that everyone, all parties involved, have a lawyer who is looking out for that party’s interests. This ensures that each side of the arrangement has had a chance to communicate their wants and needs and has been given the same opportunity to weigh in on the contract language, making sure each side feels honored and protected throughout the process. This also prevents misunderstandings that could get in the way of the partnership between intended parents and the gestational carrier (or donor).
It’s an added expense to an already expensive process, but it makes sure that the investment you are making in your family has the best chance of success from a legal standpoint.
